- Our Products and Bespoke Services
- Ready-to-wear Products
- We offer Products for sale on the Website. Each Product listing includes key information such as sizing guidance, materials and price.
- Product images are for illustration only. While we try to display colours accurately, colours may vary between devices and batches, and small variations can occur. Products made from natural fabrics (such as wool, linen and silk) may also have inherent variations in texture, weight, weave and appearance that are characteristic of the material and are not defects. It is your responsibility to follow any care instructions provided with Products (including on labels and packaging); damage resulting from failure to follow those instructions will not constitute a defect.
- If you have questions about sizing, materials or care instructions, please contact us before placing your Order.
- Bespoke Services
- Bespoke Services are a personalised tailoring service that results in a finished garment made to your individual specifications. Because of this, Bespoke Orders are treated differently from off-the-shelf Products including for cancellation, as explained in Section 14.
- The usual bespoke process includes:
- an initial consultation to discuss your requirements and preferences;
- taking measurements to support fit;
- selection of fabric, lining and other options;
- one or more fitting appointments; and
- completion, finishing and delivery or collection of the garment.
- We will confirm the agreed specifications for your Bespoke Order in writing. Those specifications form part of the Contract.
- Made-to-measure tolerances. Each made-to-measure garment is individually drafted, cut and handcrafted to the agreed specifications. Minor manufacturing variations are a normal part of the bespoke tailoring process. Unless otherwise expressly stated in the written specifications for your Bespoke Order, finished garment measurements may vary by up to 1.0 cm above or below the agreed garment measurements when measured using our standard measurement methodology. The final dimensions, drape, appearance and fit of a garment may also be influenced by the characteristics of the selected fabric, including its composition, weight, weave, stretch, finish and response to cutting, pressing, shaping and other tailoring processes. Natural variations in fabric behaviour may affect how a garment performs and settles during wear. Before your Bespoke Order is confirmed, we will set out in, or provide with, the written specifications the garment measurements, any applicable measurement tolerances and the measurement methodology used to assess those measurements. The fitting process is an integral part of the Bespoke Services. Any alterations or adjustments that we reasonably carry out during that process to achieve the agreed fit, balance and overall appearance of the garment do not, by themselves, indicate that the garment is defective, non-conforming or that the Bespoke Services have not been performed with reasonable care and skill. A variation within an applicable disclosed tolerance does not, by itself, mean that the garment fails to conform to the agreed specifications. Nothing in this clause limits or excludes your statutory rights, including where a garment fails to conform to the agreed specifications or the Bespoke Services have not been carried out with reasonable care and skill.
- Specific terms also apply to Bespoke Services, including the sections on Bespoke Services: Timeline and Delivery, Bespoke Services: Alterations, Intellectual Property, and Cancellation Rights for Bespoke Services. Please read those sections carefully as they affect your rights.
- Website availability
- We do not guarantee that the Website will always be available, uninterrupted, secure or error-free. We may suspend, withdraw, restrict or change all or any part of the Website for maintenance, technical or operational reasons and may do so without notice. We will not be liable for any loss or inconvenience arising from the Website being unavailable, provided this does not affect any existing Contract.
- How to place an Order
- Ordering Products
- To order Products, add items to your basket, proceed to checkout and follow the on-screen instructions.
- After you place an Order, we will send you an acknowledgement email. This is not acceptance of your Order.
- Ordering Bespoke Services
- To order Bespoke Services, you must book a consultation with us. During or after the consultation we will discuss and agree the design and specifications for your garment and provide a price quote.
- Your Bespoke Order is placed when you confirm in writing that you wish to proceed on the agreed specifications and price, for example by email or by telephone, and you pay any required deposit.
- Order acceptance and when the Contract is formed
- We accept your Order when we issue an Order Confirmation. At that point a Contract is formed between you and us.
- If we cannot accept your Order, we will tell you and if you have already paid, we will refund you promptly using the same payment method you used, unless we agree otherwise.
- Our right to decline Orders
We may decline an Order for example, because the Product is out of stock, we cannot meet a delivery deadline you have requested, there is a pricing or description error, or we suspect fraud. If we do, we will not charge you or we will refund you if you have already paid.
- Where an order is placed by a customer under the age of 18, we reserve the right to:
- Refuse to accept the order;
- Require the involvement of a parent or legal guardian; and / or
- Make acceptance of the Order conditional upon a parent or legal guardian agreeing to these terms and conditions.
- Parent or Legal Guardian as Contracting Party
- Where we request the involvement of a parent or legal guardian, we may require that person to:
- Place the order on your behalf; or
- Agree to be the contracting party responsible for the Orde including payment obligations.
In such cases the parent or legal guardian will be treated as the customer for the purposes of the contract.
- Price and payment
- Products
- Prices for Products are shown on the Website and include VAT unless the Website clearly states otherwise.
- We take reasonable care to ensure Product prices are correct. If we discover an obvious pricing error before dispatch, we will contact you and give you the option to (i) reconfirm your Order at the correct price, or (ii) cancel your Order and receive a full refund.
- We accept the payment methods shown at checkout. Payment is taken at the time you place your Order or, if applicable, when your payment provider authorises the transaction.
- Bespoke Services
- Bespoke and made to measure garments are produced to your individual specifications.
- Prices for Bespoke Services are quoted to you typically after the consultation and confirmed in writing as part of the Bespoke Order. Unless we state otherwise, Bespoke Services’ prices include VAT. If the rate of VAT changes between the date of the Bespoke Order and the date you pay, we will adjust the VAT element of the price accordingly.
- Unless we agree otherwise in writing, you must pay a deposit of not less than 50% of the total agreed price at the time you place your Bespoke Order. The deposit is non-refundable except as set out in Section 14. The balance of the price is payable on completion and must be paid in full before delivery or collection of the finished garment unless agreed otherwise by us.
- If you cancel a Bespoke Order, what you have to pay and whether any deposit is refundable depends on when you cancel. See Section 14 which is particularly important.
- If we are unable to commence or complete a Bespoke Order for reasons within our control for example, we cannot source agreed materials or we cease to offer the relevant service, we will notify you promptly and refund all amounts paid including any deposit in full.
- Where an order is placed by a customer under 18, we may require:
- Full payment in advance; and/or
- Confirmation from a parent or guardian before production begins.
Once production has commenced cancellation rights may be limited subject to your statutory rights. If an order placed by or on behalf of a customer under 18 is cancelled after production has commenced, we reserve the right to retain or recover reasonable costs incurred. We reserve the right in our sole discretion to decline to accept or continue any order involving a customer under the age of 18.
- GIFT CARDS, VOUCHERS AND PROMOTIONAL CODES
- Promotional codes. Promotional codes must be applied at checkout and cannot be applied retrospectively to completed Orders. Unless expressly stated, they may not be combined with any other promotions. We reserve the right to withdraw or amend any promotion at any time before an Order is accepted.
- Refunds where a discount was applied. If an Order placed using a Voucher or promotional code is cancelled or returned, we will refund only the net amount actually paid by you.
- Delivery of Products
- We will tell you the available delivery options and estimated delivery times during checkout and in your Order Confirmation. Unless we agree a different delivery date with you, we will deliver within 30 days of the Order Confirmation.
- Delivery costs are as shown on the Website and during checkout.
- We use third-party carriers to deliver Products. While we take reasonable care to select reliable carriers, we are not responsible for delays caused solely by the carrier provided we have dispatched on time. If Products are lost or damaged in transit, please contact us and we will deal with the matter as required by law.
- A Product is delivered when it comes into your physical possession or the physical possession of a person identified by you to take possession of it. Responsibility for the Product passes to you on delivery.
- You own a Product once we have received payment in full and it has been delivered to you.
- If no one is available at your address to take delivery and the Products cannot be posted through your letterbox, we or the carrier will leave a note with details of how to rearrange delivery or collect the Products.
- If you do not rearrange delivery or collect the Products as applicable, we may contact you for further instructions and may charge you for storage and any further delivery costs. If, despite our reasonable efforts, we cannot contact you or arrange delivery, we may end the Contract and refund you the price you paid for the Products less any reasonable costs we have incurred.
- If we do not deliver the Products on time, you may ask us to deliver again within an additional reasonable time. If we still do not deliver within that time, you may have the right to end the Contract and receive a refund in accordance with your legal rights.
- Third-party production specialists. We may engage specialist third-party craftspeople or workshops to assist with production of bespoke garments for example, specialist embroidery, fabric dyeing, button-making or other specialist finishing. We remain fully responsible to you for the quality and conformity of the finished garment regardless of any third-party involvement in production. We are not responsible for delays outside our control. See Section 17.
- International Delivery. Where we offer delivery outside the UK, available destinations and charges will be shown at checkout. For an International Order, you are solely responsible for any applicable import duties, customs fees, local taxes and other charges levied by the destination country; these are not included in the price and we have no control over or liability for them. We are not responsible for delays caused by customs clearance. If Products are confiscated or destroyed by customs authorities, we are not liable, but we will use reasonable endeavours to assist you where possible. You are responsible for ensuring that Products comply with local laws and regulations in your country. These Terms and your consumer rights under English law are not affected by the location of delivery.
- Bespoke Services: timeline and delivery
- Our estimated lead time for Bespoke Services is between 6 and 12 weeks from the date of the Order Confirmation, unless we agree a different timeline with you in writing. Lead times are estimates only and may change depending on availability of materials and your availability for fittings.
- Fitting appointments are an important part of the bespoke process. We will agree the number and timing of fittings with you as part of your Bespoke Order.
- You are responsible for ensuring that all measurements and personal information you provide to us whether in person, online or otherwise are accurate and complete, and you must attend fittings at the agreed times or promptly reschedule and provide any information we reasonably request including updated measurements where relevant. If you provide materially inaccurate measurements or fail to disclose relevant information that may affect fit for example, a significant change in body measurements between the taking of measurements and production, any resulting fit issues will not constitute a defect under these Terms and any alterations required to address such issues will be treated as paid alterations under Section 9. You should raise any concerns about fit at each fitting appointment.
- We will tell you when the finished garment is ready and will either (i) deliver it to you, or (ii) make it available for collection, as agreed in the Bespoke Order.
- We expect each Bespoke Order to be completed and paid in full within 10 weeks of the date of the Order Confirmation, unless an extension has been agreed with us in writing in advance due to exceptional circumstances. The balance remains payable in accordance with clause 7.2.3 and must be paid in full before delivery or collection of the finished garment.
- If completion or delivery is delayed because of something you do or fail to do, we will contact you to agree a revised timeline. We are not responsible for resulting delays.
- We are not responsible for delays outside our control. See Section 17.
- BESPOKE SERVICES: ALTERATIONS
- Complimentary Alterations
- Within 6 weeks of delivery, we will carry out minor fit adjustments to your bespoke garment free of charge where needed to achieve the fit consistent with the agreed specifications. This does not include changes to the agreed design, style, fabric, lining or features, or fit issues caused by a material change in your measurements after the final fitting.
- To request a Complimentary Alteration, please contact us using the details in Section 3, telling us your Order number and describing the adjustment you need (an Alteration Request). We will arrange an appointment within a reasonable time.
- Paid alterations
- We also offer a paid alteration service for requests that fall outside the scope or timeframe of a Complimentary Alteration. We will quote the charges to you before any work is carried out and you must agree them in writing. Payment is due on collection or before re-delivery of the garment.
- Major modifications (for example restyling, changing the silhouette, replacing fabric panels or adding/removing structural features) fall outside our alteration service. If you want any major modifications, we will treat this as a new Bespoke Order, subject to a separate consultation, specification and price.
- Third-party alterations
- If you arrange for any alterations to your bespoke garment to be carried out by a third party, we will no longer be responsible for the fit, finish or condition of the garment, and our obligations under Section 13 (statutory rights) will not extend to any defect or issue caused or contributed to by that third-party alteration.
- We strongly recommend you contact us before having any work done on the garment by a third party.
- Alterations and statutory rights
- Nothing in this section affects your statutory rights in respect of a garment that is faulty or does not conform to the agreed specification. See Section 13.
- INTELLECTUAL PROPERTY
- Ownership of designs and patterns
- All Intellectual Property Rights in the designs, patterns, templates, cuts and other creative elements contributed by us in connection with a Bespoke Order remain our exclusive property. Placing a Bespoke Order does not transfer any such rights to you.
- You own the physical garment once payment has been made in full. However, owning the garment does not include any licence to reproduce the design, pattern or cut for commercial purposes or to commission copies of the garment from third parties for resale or other commercial use.
- Retention of patterns
- We may retain patterns, blocks and measurement records created in connection with a Bespoke Order to help with future orders and alterations. We will handle all personal data (including measurements) in accordance with our Privacy Policy and applicable data protection law.
- Photography and marketing
- We may wish to photograph or otherwise record finished bespoke garments for portfolio, editorial or marketing purposes. We will ask for your consent before using any images in which you are identifiable. You may withdraw consent at any time by contacting us using the details in Section 3.
- Where you consent to photography, you grant us a non-exclusive, royalty-free licence to use images of the finished garment not identifying you without your consent for our marketing, social media and portfolio materials.
- Your materials and references
- If you provide us with any materials, sketches, designs or references that belong to you or a third party in connection with a Bespoke Order, you confirm that you have all necessary rights to share them with us and to allow us to use them to produce your garment. You agree to indemnify us against any third-party claim arising from our use of those materials in accordance with your instructions.
- Cancellation rights for PRODUCTS: ready-to-wear
- If you buy Products online or by distance means, you usually have a legal right to change your mind and cancel the Contract within 14 days without giving any reason. This is your Cancellation Period.
- The Cancellation Period for Products ends 14 days after the day on which you receive the Products. If your Order is split into several deliveries, the Cancellation Period ends 14 days after the day you receive the last item.
- To cancel, you must tell us clearly that you want to cancel. You can do this by email or post using the details in Section 4, or by using the model cancellation form in Section 22.6 (Schedule 1).
- You must send the Products back to us within 14 days of telling us you want to cancel. You are responsible for the cost of return postage unless the Products are faulty or not as described.
- Please return Products in their original condition, unworn, with tags attached and in original packaging. You may take reasonable steps to inspect and try on Products as you would in a shop, but if you handle them more than necessary, we may reduce your refund to reflect any loss in value.
- If you cancel under this Section 13, we will refund you: (i) the price you paid for the Products; and (ii) the cost of standard delivery but not any extra cost you chose for a faster or enhanced delivery option.
- We will make the refund within 14 days of the earlier of: (i) the day we receive the returned Products; or (ii) the day you provide evidence that you have sent the Products back to us. We will refund you using the same payment method you used, unless we agree otherwise.
- This Section 13 does not affect your legal rights if Products are faulty or not as described.
- Cancellation rights for Bespoke Services (IMPORTANT PLEASE READ)
- Please read this Section 14 carefully. Bespoke Orders result in goods made to your individual specifications.
- Under Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the usual 14-day right to cancel does not apply to goods made to a consumer’s specifications or clearly personalised once production has commenced.
- You may cancel a Bespoke Order before production commences by giving us written notice for example by email. If you do, the deposit will be forfeited to cover costs we have already incurred up to that point for example consultation time, pattern cutting, ordering materials or reserving workshop time, but we will not charge you any further amounts.
- Once production has commenced, you do not have a right to cancel the Bespoke Order for change-of-mind reasons and the full Contract price remains payable subject always to your rights if the finished garment is faulty or not as described.
- Nothing in this Section 14 affects your legal rights in relation to faulty or non-conforming goods or services. See Section 15.
- Your statutory RIGHTS: faulty or non-conforming goods and services
- We must provide Products that are as described, fit for purpose and of satisfactory quality. We must provide Bespoke Services with reasonable care and skill. Your legal rights are set out in the Consumer Rights Act 2015 and other applicable consumer protection laws.
- If Products are faulty or not as described, you may be entitled to a full refund if you reject them within 30 days of delivery the “short-term right to reject”.
- If the short-term right to reject does not apply or has passed, you may be entitled to a repair or replacement. If that is not possible, or it is not done within a reasonable time or without significant inconvenience to you, you may be entitled to a price reduction or a refund.
- If a fault appears within 6 months of delivery, it is assumed to have been there at the time of delivery unless we can prove otherwise. After 6 months, you may need to prove the fault was present at the time of delivery.
- For Bespoke Services, if the finished garment does not conform to the agreed specifications or the services were not performed with reasonable care and skill, your Consumer Rights Act 2015 rights apply in full.
- Our alteration service for bespoke garments (including Complimentary Alterations) is set out in the Bespoke Services: Alterations section. Nothing in that section affects your statutory rights.
- To report a fault or non-conformity, contact us using the details in Section 4, providing your Order number and a description of the issue and photos where helpful. We will tell you what happens next and, where relevant, how to return items to us.
- Our liability
- We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking the Contract or our failing to use reasonable care and skill.
- We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or for breach of your statutory rights (including under the Consumer Rights Act 2015).
- Subject to Section 16.2, we are not liable for: (i) losses that were not foreseeable to you and us when the Contract was formed; or (ii) indirect or consequential loss, loss of profit, loss of opportunity or loss of business.
- Subject to Section 16.2, our total liability to you under or in connection with a Contract will not exceed the total amounts you have paid under that Contract.
- Nothing in these Terms affects your statutory rights as a consumer.
- Events outside our control : force majeure
- An Event Outside Our Control means an event or circumstance beyond our reasonable control that prevents or delays us from performing our obligations under a Contract for example, extreme weather, fire, flood, epidemic or pandemic, government action, strikes, or supply chain disruption.
- If an Event Outside Our Control happens, we will contact you as soon as reasonably possible and tell you how it affects our performance. Our obligations will be suspended for the duration of the Event Outside Our Control.
- If the Event Outside Our Control delays delivery or completion by more than 6 months, you may end the Contract by giving us written notice. If you do, we will refund all amounts you have paid for anything we have not supplied.
- We will not compensate you for delays caused by an Event Outside Our Control.
- Privacy and data protection
- We process your personal data (which may include measurements and other information you provide for Bespoke Services) in accordance with our Privacy Policy (https://shawsclothingcompany.com/privacy-policy/) and applicable data protection law, including the UK GDPR and the Data Protection Act 2018.
- We use your personal data to fulfil Orders, provide customer support, manage your account if applicable, communicate with you about your Order, and comply with our legal obligations. We keep your personal data only for as long as needed for those purposes including record-keeping and legal compliance.
- Complaints
- If you have a complaint, please contact us using the details in Section 4 and provide your Order number and a description of the issue.
- We aim to respond within 10 Business Days.
- If we cannot resolve your complaint, you may be able to use Alternative Dispute Resolution (ADR). We will tell you the name and website address of an appropriate ADR entity and whether we will use ADR. Your right to take legal action is not affected.
- Changes to these Terms
- We may update these Terms from time to time. The Terms that apply to your Contract are the version in force at the time you place your Order.
- If we make material changes to these Terms, we will take reasonable steps to notify you in advance for example by posting the updated Terms on the Website and/or emailing you, where reasonably practicable.
- Governing law and jurisdiction
- These Terms and any Contract between you and us are governed by the law of England and Wales.
- If you and we have a dispute, the courts of England and Wales will have exclusive jurisdiction. However, if you are a consumer, you may also bring proceedings in the courts of the part of the UK where you live.
- General
- Entire agreement. These Terms together with any documents expressly referred to in them, such as the Order Confirmation form the entire agreement between you and us in relation to their subject matter and replace any prior discussions or arrangements.
- Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- Waiver. If we do not insist immediately that you do something you are required to do under these Terms, or if we delay taking steps against you in respect of your breaking the Contract, we will still be able to enforce our rights later.
- No third party rights. The Contracts (Rights of Third Parties) Act 1999 does not apply to the Contract. This means that only you and we can enforce it.
- Headings. Headings are for convenience only and do not affect interpretation.
- Assignment. We may assign or transfer our rights and obligations under these Terms to another entity for example in connection with a business sale, merger or restructure, provided this does not materially prejudice your rights under the Contract. We will give you reasonable notice. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
- Subcontracting. We may subcontract any of our obligations to third parties, including third-party carriers and specialist craftspeople. We remain fully responsible to you for performance of our obligations regardless of any subcontracting arrangement.
- Electronic communications. By using the Website and placing an Order, you agree that we may communicate with you electronically including by email and via the Website and that such communications satisfy any requirement for communications to be made in writing.
